Veteran’s Benefits

Hi, I'm Dan Surpinott[sp?] of Surpinott[sp?] and Venesky[sp?]. First of all, if you're a veteran we'd like to thank you for your service and your sacrifice, it's greatly appreciated. As estate planning attorneys, we look for all the tools that we can in order to protect assets for our clients. One tool in the toolbox is the Aide and Attendants benefit from the Veterans Administration.

This benefit can bring in up to $2,000 per month to help offset the cost of care. It's a non-service connected disability benefit. That means that the disability doesn't have to have anything to do with the service. It can be due to age-related issues like mobility or memory issues. However, it's not for healthy, vigorous individuals who don't need the assistance of another.

It's for people who need at least some assistance. If so, you may qualify to receive Aide and Attendants Pension from the VA.

Estate planning can help you to meet the asset and income limits. To learn more, just download our free guide, "The Nuts and Bolts Guide to Veterans' Benefit Planning", or click on the consultation tab to see if you qualify for a free, no-obligation consultation.

For many veterans in Southeastern Massachusetts and Cape Cod, the rising cost of assisted living or home health care can be staggering. The good news is that there is a little-known VA benefit that can help you get the care you need without using up all of your hard-earned savings.

We’re Bob Surprenant, Michelle Beneski and Dan Surprenant, Personal Family LawyersTM with Surprenant & Beneski in New Bedford, Brockton and Hyannis Massachusetts.  Our Firm has been helping Massachusetts’ families for nearly 40 years.

We use a common sense approach to help you qualify for Veterans and/or Medicaid (MassHealth) benefits to pay for your long-term care in Massachusetts.

You owe it to yourself to understand the VA’s Aid & Attendance benefit programs that are available to those honorably discharged veterans who are over 65 and are struggling with the cost of their medical care.

If you or a member of your family is an honorably discharged veteran who served at least one day during a period of wartime (the definition of “wartime” may be broader than you think), and if you are in an assisted living facility or are spending several hundred dollars a month or more on the cost of your health care, then you may qualify for benefits under the VA Aid and Attendance Pension Program.

To learn more about the benefits you may be missing out on, we would like to offer you a FREE copy of our informative report, ”The Nut’s & Bolt’s Guide to Veteran’s Aid and Attendance Benefit Programs.”

Here are some of the secrets we reveal…

  • How you may qualify for a benefit of up to $2020/month
  • How the widow of a veteran may qualify for a benefit of up to $1094/month
  • The asset and income limitations that you must meet in order to become eligible
  • How making gifts to your children can make you ineligible for government benefits…and the steps you should take right now, BEFORE you apply to the VA, to make sure that you don’t harm your chances of qualifying
  • Plus, you’ll learn how to protect your eligibility for Massachusetts’s Medicaid, should you need long-term nursing home care

…Because everyone’s situation is unique, we’ll also include a certificate with your report for a FREE Consultation with a qualified professional.  We’ll be happy to answer any questions you may have about the benefits that you’ve earned.

Here at Surprenant & Beneski, P.C. we can assist you and your family by explaining many difficult-to-understand things about long-term care and Veterans benefits.

Qualification for a veteran benefit is only one of several concerns that must be considered.  As you struggle to provide dignified long-term care for a wartime veteran and/or their spouse, we can help you understand the options.

We are your advocates.  We want to help you stretch your hard earned money further.  VA benefits are only one part of the puzzle.  We will hold your hand and guide you every step of the way as we consider all of your and your family’s resources.

You may need guidance to make sense of the following:

  1. Estate plan documents such as powers of attorney, wills, and possibly trusts
  2. Analysis of any income tax, estate tax, or gift tax issues
  3. Care options available in the local community for both the veteran and spouse
  4. A review of VA, Medicare, and Medicaid as they apply to your circumstances
  5. A review of your personal, financial, and family resources
  6. Analysis of financial suitability of any asset (preservation)
  7. Analysis of both positives and negatives of all planning options
  8. A calculation of the actual dollar benefit and/or cost of any helpful idea that is discussed
  9. Possible submission of the VA claim form.

Once a Veteran has expressed that he or she wants to file a specific claim for VA benefits, an attorney who prepares the claim must do so on a free (pro bono) basis (see point 9 above) or refer you to the Veterans Administration or a Veterans Service Organization, which will prepare your claim for free.
